The distinction between law and policy is important and whether an ethics policy for an organization can be considered a law depends on several factors. An ethics policy for an organization typically outlines the guidelines that employees and members should follow. It serves as the internal framework of ethical behavior, should guide decision making, and set the expectations for working within the organization. I do not believe that including consequences for violating ethics policies necessarily makes it into a law. The judicial process is in place to allow for bills to be presented and approved by the branches of government and elected officials to ensure these bills adhere to the standards of the legal system in the USA. There are safeguards in place that laws do not affect the legal rights and freedoms of individual’s within the jurisdiction (Kwasau et. al., 2023). However, there is not a safeguard that ensures policies in a organization do not impact the rights and freedoms of the people. Laws are enacted and enforced by the government authority and have legal consequences such as fines and imprisonment. Violating an ethics policy in an organization may have harsh consequences such as loss of employment, however ethics policies are enforced by leadership within the company and created by leadership to manage internal affairs. Ethical policies, consequences or not, do not go through the same process that one must go through to become a law. Furthermore, the law is applicable to everyone within a jurisdiction, but the ethics policy only pertains to the employees of the organization that created it.

Law is interpreted by lawyers, judges, and law enforcement as a binary framework of “right” and “wrong.” Another difference is that policy can be changed if leadership agrees, and policy consequences can consider many more factors before a consequence. Law has a written consequence and severity based on the broken law and does not allow the authority the same flexibility in determining those consequences when violations occur. With these differences, I do not believe that an ethics policy can be synonymous to a law although that may not prevent organizations from including certain laws that pertain to their business within their ethics policies.
