I feel that the theory of restorative justice is the most appealing. This theory really emphasizes repairing the harm that is caused by criminals and it focuses on the rehabilitation of the offenders. This would involve everybody involved in the crime to come together and figure out a solution. While I don’t think this could work in all cases especially very sensitive ones such as rape, I do think for other crimes is it very important for the offender to meet and talk with the victims. This really can really show the offender how his actions affect everybody involved and I hope it will deter them from doing more crimes in the future.
I think it is very important for the punishment to reflect the crime. I think the only crimes that would be worthy of prison time should be where another life is taken on purpose or where another person’s life is permanently affected. Not all crimes are equal and there shouldn’t be a one size fits all when it comes to sentencing. I think it is very disgusting to see people in prison for drug-related crimes and nonviolent offenses.
Considering Bob and Sally’s case, I think a more fitting punishment should be making sure Bob knows the damage he has done to sally by sitting down and having a discussion with her to hopefully give him empathy in the situation. There should also be some education or community service required and maybe a small fine that is given to Sally to hopefully help her grieve. We should be targeting the root of why he did the crime in the first place and encouraging personal growth instead of just punishing him which only leads to him having less remorse and more anger towards the situation and lead him to commit the crime again.
I think when it comes to taking a life, I see incarceration as the only form of punishment. I think the main focus should still be on rehabilitation. A combination of incarceration, therapy, and restitution to the victim’s family would be best. I know there are many stories where the victim’s family has found closure by communicating with the offender. I think a therapist must see a sense of remorse in the offender before there is ever a chance of them going back into the normal world. I think in cases where an offender never feels remorse then they should never be released back into the public. I also believe there should be some restitution to the victim’s family but what that restitution is I don’t know. Maybe the offender should be required to pay for the victim’s family’s therapy and the costs that come from losing a family member.
